Terms and Definitions

Key terms used throughout this agreement

  1. Applicant's Area – a workspace created in the web-interface, used by the Applicant for submitting rental applications, making payments, and viewing status updates.
  2. Applicant – any person over 18 years of age, using the services of the Company in accordance with this Agreement.
  3. Company – SkyHigh Realty NYC LLC, which provides tenant application processing, background screening, credit checks, and related services in accordance with this Agreement.
  4. Screening Operation – the process of obtaining and compiling consumer credit reports, criminal background checks, eviction/tenant history, income/employment verification, and other permissible reports from third-party sources.
  5. Application Fee – the non-refundable fee paid by the Applicant to initiate the Screening Operation.
  6. Landlord / Client – the property owner, manager, or authorized representative who receives Screening Reports through the Company's platform.
  7. Platform – the Company's online web interface and system used for application submission, payment processing, and delivery of screening results.

General Provisions

Terms governing the use of our services

  1. The service provided by the Company is an Internet-based platform that enables Applicants to submit rental applications and authorizes the Company to perform Screening Operations for Landlords/Clients. Use of the service requires a stable high-speed Internet connection on the Applicant's device.
  2. In its activities, the Company is guided by applicable U.S. federal and state laws, including the Fair Credit Reporting Act (FCRA), fair housing laws, and regulations on permissible purpose for consumer reports. The Company requires the Applicant to provide accurate personal data and reserves the right to verify identity using:
    • Upload of scanned copies of government-issued ID and proof of address;
    • Phone or email verification;
    • Other methods necessary at the Company's discretion.
  3. An Applicant is prohibited from submitting multiple applications for the same property or creating duplicate profiles. The Company reserves the right to cancel applications or void results in case of duplicate submissions.
  4. The Applicant's Area is registered on the Company's official website. The Company guarantees confidentiality of personal data in accordance with applicable privacy laws and its Privacy Policy.
  5. The Applicant is responsible for the safety of authentication data (login/password). In case of loss of access, the Applicant must immediately notify the Company to block unauthorized access.
  6. Upon submission of the application and payment of the Application Fee, the Company automatically initiates the Screening Operation.
  7. The Company obtains Screening Reports from third-party consumer reporting agencies and other sources. The Company does not guarantee the accuracy, completeness, or outcome of any report and is not responsible for Landlord decisions based on the reports.
  8. The Company prohibits any fraudulent activity, submission of false information, abusive use of the Platform, or attempts to circumvent the screening process. In such cases, the Company reserves the right to terminate access, forfeit fees, and report violations to authorities.
  9. The Company reserves the right to refuse service or terminate this Agreement in cases of unfair attitude toward the Company, including insults, defamation, false reviews, or attempted extortion.
  10. The Applicant shall ensure that his/her activities comply with the laws of the jurisdiction where they reside or apply.
  11. The Applicant is responsible for payment of any taxes arising from use of the services.
  12. The Company reserves the right to limit availability of services or features at its discretion.
  13. The Company may restrict services to residents of certain jurisdictions or in cases where compliance cannot be ensured.

Procedure of Application and Payment Execution

How applications and payments are processed

Important Notice

All Application Fees are strictly NON-REFUNDABLE, regardless of application outcome, withdrawal, incompleteness, or Landlord decision.

  1. Application submission and Screening Operations are performed through the Applicant's Area on the Platform.
  2. All Application Fees are strictly NON-REFUNDABLE, regardless of application outcome, withdrawal, incompleteness, or Landlord decision. The fee covers processing, third-party report costs, and administrative services incurred immediately upon submission.
  3. Minimum Application Fee: $30 USD per adult applicant. Payment is made via accepted electronic methods (credit/debit card, etc.).
  4. The Applicant guarantees use of personal funds and accurate information. The Company may request verification documents (ID, proof of income, etc.) and reserves the right to decline or cancel if discrepancies are found.
  5. Screening Reports are ordered only after successful payment. Results are delivered to the designated Landlord/Client for their independent review and decision.
  6. The Company does not allow use of the service for purposes other than legitimate tenancy screening. Unauthorized or abusive use voids any rights to refunds or services.

Disclaimer of Warranties and Limitation of Liability

Limitations on our warranties and liability

  1. The Company provides services "as is" without any warranties, express or implied, regarding accuracy, completeness, or results of Screening Operations.
  2. The Company is not liable for any indirect, consequential, or punitive damages, including denial of tenancy, financial loss, or inaccuracies in third-party reports.
  3. Maximum liability of the Company shall not exceed the Application Fee paid by the Applicant.
  4. Any disputes regarding report accuracy must be directed to the relevant consumer reporting agency in accordance with FCRA procedures.

Amendments and Governing Law

Changes to terms and applicable law

  1. The Company reserves the right to amend these Terms at any time. Continued use of the service constitutes acceptance of changes.
  2. This Agreement is governed by the laws of the State of New York, without regard to conflict of law principles.
